Though many of our guests do not realize it, the Caribbean resort Grand Case Beach Club is a privately owned condominium development. All units are presently sold, but we do have some units available for resale.
Saint Martin is part of France, in the department (state) of Guadeloupe, and people who buy real estate enjoy all the legal protections that the Republic, which was founded over 200 years ago, offers its citizens. Unlike the United States, with its adversarial legal system, the system, the French, under the Napoleonic legal system, employ a Notaire (Notary) to represent both buyer and seller, and he makes sure that both parties are treated fairly. The Notaire is a lawyer with special government authority to perform many functions pertaining to civil law. As such, he performs his duties as a "Friend of the Court", therefore he is not able to represent either party in the transaction, and makes sure that each party is treated in an equitable way. The Notaries fees are modest by United States standards, and the fees can be discussed with his office. Generally, the fee for the Notaire's services are paid for by the buyer (typically about 12% additional). Title of the property can be taken by one or more individuals, or by a domestic or foreign corporation. Foreigners are able to buy real estate in St. Martin with no restrictions.
